Introduction and General Terms

1.1. These Terms of Service govern your use of the Legend Games LLC website, mobile application, and physical card game (collectively, the "Service").
1.2. By using the Service, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference into these Terms of Service. If you do not agree to these Terms of Service or the Privacy Policy, you may not use the Service.
1.3. We reserve the right, at our sole discretion, to change or modify these Terms of Service at any time. Any changes or modifications will be effective immediately upon posting the updated Terms of Service on the Service. Your continued use of the Service following the posting of any changes or modifications constitutes acceptance of such changes or modifications.

Intellectual Property

2.1. The Service, including but not limited to the Mythrel game, its rules, images, illustrations, text, music, sounds, and other components, and all intellectual property rights associated therewith, are owned by Legend Games LLC or its licensors.
2.2. You may not reproduce, distribute, sell, trade, resell, or exploit for any commercial purposes any part of the Service without the express consent of Legend Games LLC.

User-Generated Content

3.1. The Service may allow you to create, upload, post, send, or store content, including but not limited to game strategies, deck lists, and commentary (“User-Generated Content”). By submitting User-Generated Content to the Service, you grant Legend Games LLC a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable and transferable license to use, copy, distribute, prepare derivative works of, display, perform, and otherwise exploit in any manner such User-Generated Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and Legend Games LLC’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
3.2. You are solely responsible for your User-Generated Content and the consequences of posting or publishing it. By submitting User-Generated Content to the Service, you represent and warrant that: You are the creator of the User-Generated Content and own or have the necessary rights, licenses, consents, and permissions to use and to authorize Legend Games LLC to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User-Generated Content to enable inclusion and use of the User-Generated Content in the manner contemplated by the Service and these Terms of Service;
The User-Generated Content does not infringe, misappropriate or violate a third party's patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy;
The User-Generated Content does not violate these terms and conditions;
The User-Generated Content does not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines.

User Conduct

4.1. You agree that you will not use the Service to engage in any activity that is illegal, fraudulent, or malicious, including but not limited to hacking, phishing, distributing malware, or spreading misinformation.
4.2. You agree that you will not use the Service to engage in any activity that is abusive, harassing, bullying, threatening, or that promotes discrimination or hate speech based on race, religion, gender, sexual orientation, or other protected characteristics.
4.3. You agree that you will not use the Service to engage in any activity that is disruptive or that interferes with the normal functioning of the Service or that interferes with the enjoyment of the Service by other users.
4.4. You agree that you will not use the Service to engage in any activity that uses cheat codes, automation software (bots), mods, hacks, or any other unauthorized third-party software designed to modify or interfere with the Service.
4.5. You agree that you will not use the Service to engage in any activity that involves buying, selling, trading, or otherwise transferring your account or any items or virtual currency obtained through the Service to any other person or entity (cards are an exception), unless specifically authorized by Legend Games LLC.
4.6. You acknowledge that Legend Games LLC reserves the right to terminate your access to the Service or take such other action as it deems appropriate if you engage in any activity that violates these Terms of Service or that is otherwise illegal, fraudulent, or malicious.

Disclaimer of Warranties

5.1. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” AND LEGEND GAMES LLC EXPRESSLY DISCLAIMS ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.
5.2. LEGEND GAMES LLC MAKES NO WARRANTY THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS, (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
5.3. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE SERVICE.

Limitation of Liability

6.1. IN NO EVENT SHALL LEGEND GAMES LLC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.
6.2. UNDER NO CIRCUMSTANCES WILL LEGEND GAMES LLC BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

Indemnification

7.1. You agree to indemnify, defend and hold harmless Legend Games LLC, its affiliates, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Service or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.

Miscellaneous

8.1. These Terms of Service and the relationship between you and Legend Games LLC shall be governed by the laws of the State of Idaho without regard to its conflict of law provisions.
8.2. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.
8.3. The failure of Legend Games LLC to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
8.4. The Terms of Service comprises the entire agreement between you and Legend Games LLC and supersedes all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein.

Abuse of Systems

9.1. Users found to be abusing the dragon scale and booster pack transfer systems for personal gain or engaging in fraudulent activities will be subject to disciplinary action, including permanent banning from the Service.
9.2. The abuse of dragon scale and booster pack transfer systems includes, but is not limited to, any unauthorized or fraudulent activity aimed at obtaining an unfair advantage, manipulating the system, or violating the intended use of the transfer systems.
9.3. Legend Games LLC reserves the right to investigate and take appropriate action against any user suspected of abusing the dragon scale and booster pack transfer systems, including, but not limited to, removing improperly obtained dragon scales or booster packs, suspending or terminating the user's account, and pursuing legal remedies.
9.4. Legend Games LLC reserves the right to investigate, ban, IP ban, log, and take appropriate action against any user suspected of abusing any of the Legend Games LLC or Mythrel game client, servers, or systems.
9.5. "Win Trading" is a bannable offense and will result in a permanent ban from the game. Win Trading is defined as two or more players intentionally losing to each other in order to gain an unfair advantage over other players. This includes, but is not limited to, players intentionally losing to each other in order to gain experience, dragon scales, booster packs, or any other in-game currency or item.

9.4. Refunds and Chargebacks

9.4.1. All sales of digital goods are final and non-refundable, except in Legend Games LLC's sole discretion.
9.4.2. Initiating a chargeback for purchases made in the Service is considered fraud and is illegal. Users initiating chargebacks will be subject to immediate account termination, and Legend Games LLC reserves the right to pursue legal action for recovery of the transaction and any other damages caused.
9.4.3. Legend Games LLC reserves the right to investigate, ban, IP ban, log, and take appropriate action against any user suspected of initiating a chargeback in violation of these terms. All digital goods are delivered immediately upon purchase and non-refundable.
